Montava Phase D Core and Irrigation Pond, BDR240006 – Manager’s Decision
On May 1, 2024, the City of Fort Collins Development Review Division received and processed a request for the Montava Phase D Core and Irrigation Pond, a proposal for 329 alley-loaded single-unit attached and detached dwellings (parcel #8833000002) in Transects 5, 4, and 3.2 of the Montava PUD Master Plan. This request has been reviewed under the 1997 Land Use Code and the Montava PUD Master Plan Uses, Densities, and Development Standards, in accordance with Sections 2.2 and 2.18 – Basic Development Review Procedures, of the City of Fort Collins Land Use Code.
Findings of Fact
• Processing Compliance: Montava Phase D Core and Irrigation Pond, BDR240006, has been processed per Sections 2.2 and 2.18 of the Land Use Code.
• Land Use Code Compliance: The project complies with applicable sections of Article Three, General Development Standards, subject to the conditions outlined below.
• Montava PUD Master Plan Compliance: The project adheres to the Montava PUD Master Plan Uses, Densities, and Development Standards.
Conditions of Approval
Final Development Plan and Development Agreement Approval
The Developer must meet the following conditions for the City to approve the Final Development Plan, execute the Development Agreement, and release the Development Construction Permit:
1. Stormwater Infrastructure:
o Permit and construct necessary stormwater infrastructure for an adequate stormwater outfall per the Fort Collins City Code, Stormwater Criteria Manual, and Cooper Slough Stormwater Master Plan.
o Engage in design charrettes and monthly coordination meetings with City Stormwater Master Planning and Water Utilities Development Review.
2. Variances:
o Obtain all necessary variances, including:
Variances under the Fort Collins City Code and Stormwater Criteria Manual.
Variances from other City departments.
3. Design and Permits:
o Submit plans and reports at 100% design detail meeting all City standards.
o Secure all permits, property rights, and approvals, including:
Executed agreements with Larimer and Weld Irrigation Company (LWIC) and other stakeholders.
Rights from downstream property owners as determined by the City.
4. Burlington Northern Santa Fe Railroad (BNSF) Coordination:
o Obtain BNSF Engineering Review Approval for stormwater outfall design before releasing building permits.
o Secure BNSF construction permits for the stormwater outfall before releasing more than 25% of Phase D building permits.
o Complete and certify the stormwater outfall prior to releasing more than 35% of building permits.
5. FEMA Floodplain Compliance:
o Obtain a floodplain use permit with no-rise or CLOMR for work within FEMA-regulated floodplains.
Building Permit Releases
1. Up to 25% Building Permits:
o Obtain BNSF Engineering Review Approval for stormwater outfall design.
2. Up to 35% Building Permits:
o Fulfill conditions for the 25% release.
o Acquire BNSF construction permits for the stormwater outfall.
3. Remaining Building Permits:
o Install and certify all offsite drainage infrastructure per the approved Final Development Plan.
o Ensure infrastructure is accepted by the City.
